Terms of Service

1. Who Can Use Eternity

Age Requirement

You must be at least 13 years old to create an Eternity account (or the minimum digital age of consent in your country, if higher). We verify this through a date of birth field during registration. If you are under the required age, you cannot create an account.

Germany: Under GDPR and Germany's implementation of Article 8, the digital age of consent is 16. Users aged 13-15 in Germany can create accounts and use Eternity's core features (processed under contract performance), but features that rely on consent as their legal basis require parental consent for users under 16.

Children under 13 can appear in family constellations as "stars" — entries added and managed by their parent or legal guardian. These entries do not constitute accounts and do not give children independent access to the platform.

Account Responsibility

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at marko@eternity.family.

One Person, One Account

Each account represents one person. You may belong to multiple family trees (e.g., your birth family and your partner's family), but you may only have one Eternity account.

2. Your Family Tree

Creating a Tree

When you create a family tree, you become its first administrator ("Admin"). Your tree gets a constellation visualization and, optionally, a public URL at eternity.family/[family-name]. Family names for URLs are assigned first-come, first-served.

Tree Membership

Any member of a tree can invite new members. A person can belong to multiple trees. Their star appears in each tree they belong to.

Admin Rights and Responsibilities

The tree creator is the first Admin. Admins can promote other members to Admin. Admins have additional powers: removing members from the tree, archiving or removing flagged content, restricting upload permissions for specific members, and managing tree settings.

What Happens When an Admin Leaves

If the sole Admin deletes their account or leaves the tree, Admin status transfers automatically to the next longest-standing member. If no other members exist, the tree enters a 90-day grace period during which any remaining member can claim Admin status. After 90 days with no Admin, the tree is archived (not deleted) and can be restored if a member returns and claims Admin.

Deceased Members

When a family member passes away, their star can be marked as "deceased" by any Admin. Their content, stories, and memories are preserved. The deceased member's account login is deactivated, and Admin(s) of the tree manage the deceased member's star page. We plan to introduce a formal "legacy contact" feature in a future update.

3. Content on Eternity

Your Content, Your Ownership

You retain full ownership of all content you upload to Eternity — your photos, videos, voice recordings, written memories, and annotations. We do not claim ownership of your content.

License You Grant Us

By uploading content to Eternity, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, display, and serve your content to authorized members of your family tree. This license exists solely to provide the Service. Specifically, we may: store your content on our infrastructure providers, generate compressed versions for performance, display your content to members of your family tree, and include your name and basic profile information in the shareable public constellation view (names and dates only — private content is never included).

This license ends when you delete your content or your account, subject to reasonable technical delays for deletion propagation (up to 30 days) and backup retention (up to 90 days).

We will never use your content for advertising, to train AI or machine learning models, to sublicense to third parties, or for any purpose other than providing and improving the Eternity service.

Content About Other People

By uploading content that depicts or is about other people, you represent that you have a reasonable basis to share this content within your family tree, the people depicted would reasonably expect this type of sharing within a family context, and you are not uploading content to harass, embarrass, or harm anyone.

4. Acceptable Use

What you can do: Upload and organize family photos, videos, and voice recordings. Create and maintain your family constellation. Invite family members to join your tree. Share your public constellation link.

What You Must Not Do

Illegal content. Do not upload content that is illegal in your jurisdiction or ours. This includes child sexual abuse material (CSAM), content that violates others' privacy rights without consent, stolen or fraudulently obtained content, and content that promotes violence or terrorism.

CSAM — Zero tolerance. Eternity automatically scans all uploaded images for CSAM. If CSAM is detected, the content will be immediately quarantined, reported to the relevant authority, and the associated account will be permanently suspended. There are no exceptions, no appeals, and no second chances.

Harassment and abuse. Do not use Eternity to harass, stalk, threaten, or intimidate other users, including family members.

Misuse of family trees. Family trees must represent genuine family or family-like relationships. Do not create trees for organizations, fan groups, fictional characters, or other non-family purposes.

Platform abuse. Do not attempt to gain unauthorized access to other users' trees or accounts. Do not scrape, crawl, or automatically extract data from Eternity. Do not reverse-engineer our software. Do not use Eternity to distribute malware or spam. Do not circumvent storage limits or other technical restrictions.

Content Moderation

Any tree member can flag content for Admin review. Admins can remove flagged content. Eternity reserves the right to remove content that violates these Terms, though we exercise this right sparingly and only for clear violations. We do not proactively review your content (other than automated CSAM scanning).

5. Subscriptions and Payment

Free Tier

Eternity's free tier includes one family tree, up to 5 active members, unlimited placeholder stars, 50GB of storage for photos, videos, and voice recordings, full constellation visualization and sharing, and all core features.

Premium Tier

Eternity Premium is a per-tree subscription — one subscription covers everyone in the tree, not per person. Premium includes unlimited active members and unlimited storage.

Pricing

Web (via Stripe): $8.25/month or $99/year.
App Store (via Apple): $10.99/month or $129/year.

The price difference reflects Apple's commission on in-app purchases. Both plans provide identical features.

Renewal and Cancellation

Subscriptions renew automatically. You can cancel at any time through the same platform you used to subscribe (Apple App Store settings for iOS, or eternity.family account settings for web). After cancellation, your Premium features remain active until the end of the current billing period, then your tree reverts to the free tier.

We never delete your content due to a subscription change, downgrade, or cancellation. If your storage exceeds the free tier limit (50GB), you won't be able to upload new content, but all existing content remains accessible, downloadable, and exportable.

Refunds

Web subscriptions: We offer a full refund within 14 days of your initial subscription purchase. After 14 days, no refunds are issued for the current billing period, but you can cancel future renewals. This 14-day right of withdrawal is provided in compliance with the EU Consumer Rights Directive and applies to all users regardless of location.

App Store subscriptions: Refunds for App Store purchases are handled by Apple according to their refund policy. Contact Apple directly for App Store refund requests.

6. Data Export and Portability

You have the right to export your data from Eternity at any time. The export feature (available in account settings) generates a ZIP file containing all photos, videos, and voice recordings you uploaded (in their original formats and resolution), your family tree data (JSON format), memory notes and descriptions (JSON format), and your account profile information (JSON format).

Export requests are processed within 72 hours. For very large trees, processing may take up to 7 days. Data export is available to all users, free and Premium, at no additional cost.

7. The "Eternity" Promise

Our name is a promise: your family's memories should be preserved for as long as possible. We take this seriously, but we also need to be honest about what we can and cannot guarantee.

What We Commit To

Commercially reasonable preservation. Encrypted storage with redundant backups across multiple geographic locations, proactive infrastructure maintenance and technology migration as storage systems evolve.

Advance notice. If circumstances require us to change our storage or preservation approach in a way that materially affects your content, we will provide at least 90 days' advance notice.

Graceful shutdown. If Eternity ever ceases operations, we will provide at least 90 days' notice, keep the data export feature functional throughout, explore options for transferring the service to another operator, and never sell your data to third parties as part of a shutdown.

What We Cannot Guarantee

We cannot guarantee perpetual, infinite preservation of your data. No company can. This is not a guarantee of eternal storage. It is a sincere, contractual commitment to treat your family's memories with the care and permanence they deserve, for as long as we possibly can.

8. Intellectual Property

The Eternity name, logo, constellation visualization, star page design, and all original software code are the intellectual property of Eternity. You may not copy, modify, distribute, or create derivative works from our software without our written permission.

You retain all intellectual property rights in your content. We claim no ownership whatsoever.

If you send us feedback, suggestions, or feature requests, we may use them to improve Eternity without any obligation to compensate you.

9. Service Availability and Limitations

We aim for high availability but do not guarantee uninterrupted service. We may occasionally need to perform maintenance, deploy updates, or respond to incidents.

Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for data loss caused by circumstances beyond our reasonable control, including hardware failure at our infrastructure providers, cyberattacks despite our reasonable security measures, force majeure events, or user error.
• We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total aggregate liability for any claims is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

These limitations do not apply to liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, liability for fraud, and any liability that cannot be limited under EU or member state consumer protection law.

10. Dispute Resolution

These Terms are governed by the laws of Europe. For EU consumers: nothing in these Terms affects your statutory rights under the consumer protection laws of your country of residence.

We prefer to resolve issues informally. If you have a concern, please email marko@eternity.family and we'll try to work it out.

We do not use mandatory arbitration. Disputes are resolved through the courts.

EU Online Dispute Resolution. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are willing to participate in the ODR process.

11. Termination

By You

You can delete your account at any time through account settings. Account deletion triggers the data retention timeline described in our Privacy Policy.

By Us

We may suspend or terminate your account if you violate these Terms, you use Eternity for illegal purposes, your account is used to distribute CSAM (immediate, permanent termination), or you fail to respond to repeated attempts to resolve a Terms violation. Before terminating your account (except in cases of CSAM or immediate safety threats), we will provide notice and a reasonable opportunity to export your data.

12. Changes to These Terms

When we make material changes, we will email all registered users at least 30 days before the changes take effect, display a prominent notice in the app, and clearly describe what changed and why.

Continued use of Eternity after the effective date of updated Terms constitutes acceptance. If you disagree with any changes, you may delete your account before the changes take effect.

13. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eternity.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to honor these Terms. You may not assign your account or these Terms to another person.

Force majeure. We are not liable for failures or delays caused by circumstances beyond our reasonable control.
